Posted by Paul/FL on 7/8/2005, 9:28 pm, in reply to "Quit Claim Deed question" The QCD should be drawn up with the grantor being who is currently on title. The divorce degree may have already taken care of Missy Divorce being removed from title, leaving only Mister Married. The "married/unmarried" stuff should have been taken care of at the same time. But, all of this in not our (the notary) concern. Just see who is grantor, they sign, you witness along with another witness, and you notarize the signature(s)of the grantor. That's it.

Whomever is listed as "grantor" must sign the QCD. So if both Mister Married and Missy Divorced are grantor quit claiming to Mister Unmarried, then yes both would need to sign. However, if Mister Married is the only grantor, quit claiming to Mister Unmarried, then no, Missy Divorced wouldn't need to sign.
