Posted by Victoria/FL on 4/8/2005, 10:33 pm, in reply to "Re: Questions re:Witnesses" Somewhat of a funny story, I closed a loan a couple of weeks ago and since my instructions did not advise me to, I didn't ask the borrower to get another witness. However when I notarized the mortgage, I also signed as a witness. I then receive a call a week later from the title company telling me I must go back to get another witness because the county will not accept the document with only one witness! They told me that the county will accept "0" witnesses or "2" witnesses, but will reject a document with "1." I couldn't believe this, so I spoke to the clerk's office directly who advised that they don't even look at the witnesses when recording the mortgage (Hillsborough County). So the title company paid me another fee to have a document re-signed for no apparent reason. Isn't that crazy?

Although as you know, Sylvia, many lenders/title companies request/require them. It's very frustrating to have the borrower scramble to get a witness, even though it's not required.
