Together we are strong!

we were at the tirbunal today on the 21 and we did not have a lawyer but we spoke to duty councel and about the pictures we can file a t1 or a t2 not sure which one it is. She said that its hurting our enjoyment of our home. About the tribunal we lost our case about our maintance issue. I was wondering if there was anybody that knew a lawyer that helps tenants we called a bunch of people and they said that we only help LL.

: Darren,
:
: I wanted to respond to your question about
: the LL taking pictures of your personal
: things.
:
: This is an invasion of your privacy and
: those pictures used to harass you. Unless
: your apartment is being offered for rent,
: there is no reason for taking pictures.
: Dishes in the sink do not constitute any
: reason for your landlord to evict you, nor
: does the kitty litter box.
:
: Are you being represented at the Tribunal?
: I would bring this up in that situation -
: with duty counsel or your paralegal/lawyer.
:
:
: I once had a landlord who claimed that such
: innoccuous issues as dishes in the sink and
: my kids' toys on the floor were cause for
: eviction. This was nothing less than
: personal harassment and I told him that
: should he try, I would include some of the
: names he called me in a human rights
: complaint.
:
: What was he doing in your unit in the first
: place?

: my neighbour knows that she has to catch up
: and she is doing so right now she has paid
: some of it in the agreement that they have.
: A question for myself can a landlord take
: pictures of personal stuff he took a picture
: of my 13 year old daughters stuff and then
: he took pictures of most of our stuff and my
: wife ask him why is he taking pictures of
: this and he said it's my building I can do
: what I want. the LL then took a picture of
: our sink that had a few dishes in it and I
: just don't understand why is he doing this.
: Oh yes he took a picture of our litter box
: for the cat. any advice on this or is the LL
: just being a pain in the you know what..

: Rent arrears and persistent lateness are the
: top causes of eviction in Ontario.
:
: The RTA has two sections that protect
: tenants when organizing a tenant association
: and when participating in a tenant
: association.
:
: There is always the T2 application (no cost
: to the tenant to file) at the LTB if the
: landlord harasses the tenant.
:
: Bottom line is to get the rent paid up. But
: even if you don't have the rent paid up that
: doesn't give the landlord he right not to do
: repairs or keep the maintenance up.
:
: The landlord won't be able to bring up the
: rent owing at your hearing unless he files a
: cross application for rent arrears to be
: heard on the same hearing date.
:
: One of the differences between the TPA and
: the RTA is that under the RTA you can now
: bring up the lack of maintenance and repairs
: in eviction hearings. If the lack of
: maintenance is considered a "serious
: breach" then proceedings can be halted
: (or dismissed) until repairs are done. But
: don't rely on this part of the legislation
: as it's not adjudicated in an equitable
: manner at the board.

: hi all I need some advice, our neighbour is
: behind in rent by one month, she has fallen
: on hard times, she would like to support us
: for our issue with the landlord about many
: repairs that need to be done with the
: building. She is afraid that if she helps us
: there will be repercussions against her by
: trying to evict her for being behind by one
: month. Our apartments are bad our ceiling
: fell down in june and has not been fixed our
: faucet is broken in both apartments Black
: mold in both apartments and the public
: health has been called.. 1 inch crack wide
: and it runs from floor to ceiling so the
: crack is 8' tall and he said it was cosmetic
: and will not fix it. We have a date for
: court on oct21/08 and I hope that this issue
: will be fixed. Any advice for my neighbour
: on the subject..
