Hello all. Thank you in advance for any guidance. I have researched legislation, but did not find concrete answers. I realize my issues are not critical, but would like to get clarity on my rights so I can make educated decisions.
My family and I recently moved into a house in GTA. In general the house is good. However there are two issues: 1) porch has obvious dry rot and stair railings becoming increasingly unstable because of rot, 2)heating system service.
1) Porch - I have asked landlord to fix porch numerous times, however he has stated he will not be fixing porch or stairs any time soon. I am concerned as my children are very young.
- Is this potential safety issue and refused repair enough to warrant contacting inspector?
- If I do contact inspector what are ramifications to LL? Would he be contacted or fined?
2) HVAC - System works but there are cold spots (ie some rooms don't get any air). When we tried to clean system in prep for cold months it became obvious the system had not been serviced or cleaned in long time (maybe years). LL once again is not interested in servicing system.
- Is LL required to perform seasonal service?
- If I pay for system service would I be liable for damage, if any, resulting from service? I know in theory service company is liable for damage, but could LL make claim against me as well for servicing without expressed approval?
- If service reveals system issues is LL required to pay for recommended repairs?
