Cathy,
I have always known it was unethical for a landlord to get paid twice but I had no idea it was illegal!
Could you please tell me where in the legislation I can find that? Thanks.

: It is illegal in Ontario for landlords to
: 'double dip' ~ receive rent twice for the
: same period for one unit. Because you did
: not give proper notice and did not get your
: agreement in writing, your landlord is
: entitled to keep your last months rent if
: the unit is vacant. However, if he re rents
: the unit and receives rent for that month he
: is required to return your last months rent.

:
: I know you do have to give 60 days notice
: from like the first or last of the month.
: You should have got the okay in writing from
: the landord and should not have paid the
: last month that you were actually living
: there. But from a legal standpoint, I think
: he gets to keep it.
:
: Now if you were vacating 5 months early on a
: one year lease and he found someone 2
: months later, he cannot hold you liable for
: the rest of the lease.
:
: You should call the LTB 800 number.

: Hi. I recently came to a verbal agreement
: with my landlord that I could move out one
: month early. He insisted that he could find
: someone to cover the last month. Funny
: thing is, he found someone, they moved in
: and when I asked for my last month's rent
: back he claimed that since I didn't give
: proper notice, that he gets to keep it.
:
: Anybody out there had that happen?
