Air conditioning is not considered and essential service. Unless it is listed in your lease as provided by the landlord you have no recourse.

: HI,
:
: I'm very happy to have found this site. I
: leased a condo TH from a woman in August 08.
: The central air has not worked since the
: day I moved in. She sent someone who was
: part of the construction of these condos to
: look at it. A compressor needed to be
: ordered and replaced. Then communication
: with this repair person stopped and he would
: only deal with the owner. She said he
: wouldn't return her calls either. This went
: back and forth into October. I emailed her
: in March to get the ball rolling to avoid
: this being delayed into next fall. She
: insists of using the same person who
: "bailed" on her last summer. I
: asked her to get the part on order so that
: it's here to install once it gets warmer in
: May. I am getting the same runaround and
: excuses. Blaming this guy and other
: personal problems. It is obvious that she
: is trying to avoid the repair. When I bring
: up the repair with her she feels that I am
: being difficult and I'm met with either
: hostility or indifference. I have paid my
: rent on time every month.
:
: I've been told that I can't call the city
: until June for an inspector. I realize I
: have to pay the rent. I have May, June and
: July left on this lease. If the last 3
: months of my lease were not warm months I
: wouln't have a problem.
:
: Can I file a complaint somewhere to put the
: rent into escrow until she fixes it? Is
: there a way I can get out of my lease
: without a penalty? Can she be given a
: notice of violation from the city? Or does
: that not mean anything.
:
: Does anyone have any advice/suggestions for
: me? She works for the warranty company that
: takes care of the greivances for this
: development! She knows what she's doing. I
: think it's disgusting.
:
: Any help would be greatly appreciated!
