I wouldn't be so sure of that last part there Carl. If that was the case anyone who wanted to leave early in a lease could just stop paying rent and as soon as they got a N4 notice be out on the termin. date with no legal obligation? The landlord would have no legal claim to the rest of the money? Does this sound too good to be true!?!?

: Hi there,
:
: My boyfriend and I broke up half way through
: our lease. We told the landlord our
: situation and she agreed to let us out of
: our lease if we could find a replacement
: tenant. She had us post the apt at $30 more
: than we currently pay.
: After over 2 months of showing the apt (and
: believe me, we were diligently looking for
: tenants!), we didn't get any takers. The
: feedback we got was that the place was too
: expensive (the economy had dipped and she
: up'd the price instead of lowering it like
: everyone else on the rental market did).
: We told our landlord we couldn't afford to
: pay for the apartment any longer and tried
: to work out a deal. She said she'd let us
: out of our lease, so long as we paid May's
: rent and vacated the apartment before May
: 1st. We transferred all our ads to her name
: (viewit, craigslist etc), and she agreed to
: show it herself.
: It's now almost June and she hasn't found
: anyone. She is holding our deposit and will
: apply it towards June's rent if she doesn't
: find someone in the next few days... Is this
: legal?
: Can she use our deposit for June's rent when
: we don't live there anymore and no longer
: have access to keys?
: I heard somewhere that even in a lease
: agreement, the tenant is only obligated to
: give 2 months notice. Is this true?
: Please help!
