Hi, here's our situation:
We are renting month to month in an apartment managed by a large management company.
We are moving out on October 30th, so in mid August (well ahead of 60 days) we went to the office and gave them notice about moving out and booked the elevators.
We asked for any receipt or a form to fill out about our notice, but he said that a form will be sent to our suite later and said that "yes, it's that easy!" He also told us to not pay the rent for October because we paid the last month deposit when we moved in.
What we got instead, on October 6th, was that our October rent was overdue.
We went right away to the office but they (different person) said that they didn't get any notice from us. The funny thing is that the elevator was still booked by us for October 30th.
They told us that our notice to move out will be considered for December 30th, and that we are responsible to pay the rent for October and November.
We've written two letters to clarify what happened and to sort things out but they insist that it is our fault that we didn't give them a written notice.
The guy we talked to when we went to the office to give out notice still says that he doesn't remember us. Also, they are not letting us to speak to him directly to ask questions.
At our last visit, we talked with the Community Manager ("boss") and she later said that they will consider the notice for November 30th and that we are responsible to pay the rent for October.
We are very frustrated with this situation because we went to the office to inform them in mid August, well aware about the 60 days notice. We asked him MULTIPLE times whether there should be any forms to fill out, but he insisted that it was all sorted.
Since he is the person who deals with this everyday, it was only respectful and sensible for us to follow his directions and wait for a form to come to our suite, which never came.
My question is, where do we stand now? What should we do? Should we go to the head office?
