Gerry is correct just as any new landlord is bound by lease agreements(rent amount, services to be included, parking etc) or LTB agreements (rent abatement, orders to repair etc) the previous landlord has made the tenant is also obligated in the same manner. The RTA makes no reference to ownership for the purpose of an N8. If the violation occured and the paperwork is kosher i don't think the tenant will have a case. However if you run into a sympathetic adjudicator, you might have some luck. Hey it's Worth a shot!
