I think the LTB is playing with fire by empowering LTB Staff to make decisions no matter how simple. In my experience some of these people are even more biased against tenants than some of the members, and can develop personal biases against individuals who frequent LTB administrative offices on a regular basis. Case in Point: This Friday at 4:45 p.m. a woman walked into Toronto South with a notice that the Sheriff has an appointment to give up vacant possession of her unit on Monday at 12:00 p.m. The counter agent would not even listen to her claims that she had made all the payments to the landlord after the date a previous eviction order was enforcible, but months before the landlord applied to the Sheriff for removal, and was advising her that the only method of resolving the matter would be to apply for A Review of the Order (which was more than 30-days old, which would mean she would have to first apply for an extension of time.) I have been assisting this woman who has 4 children under the age of 8 years in the preparation of a Motion to Set Aside over the weekend to be filed on Monday a.m.
How can counter-staff be trusted/empowered to make binding decisions when they cant even be trusted to provide correct advice to the public, tenants or landlords alike?
