COURTS - ONTARIO
Court of Appeal
(Almost exclusively, it hears appeals from lower courts in civil, family and criminal matters. On occasion it is given a "reference", such as in the Steven Truscott matter. It is the highest appellate court in the province.)

Divisional Court
(Conducts judicial reviews and statutory appeals of provincial administrative tribunals. Also has some intermediate civil appellate jurisdiction over matters of up to $50,000.)

Superior Court of Justice
(The only truly superior court in the province. All other courts are either courts of inferior jurisdiction, courts of record or courts that were not ever courts of record. This is very significant in that this court possesses what is known as "general jurisdiction", in which jurisdiction is presumed. It may grant relief in the form of the application of all rules of equity and of the common law. It presently hears both actions and applications in civil, certain family matters, most of the more serious criminal trials and is the court of first instance in s. 522 bail applications.)

Small Claims Court
(This is a "distinct" branch of the Superior Court, with very limited jurisdiction. The anomaly here is that the judges are not federally appointed, as per s.96 of the Constitution Act, 1867. Some do question the constitutionality of this scheme, given its asserted status as a branch of a superior court. Nonetheless, it is a trial court. It is not empowered to grant equitable relief, except to order the return of certain property. The maximum quantum in claims that can be asserted in this court is $25,000.)

(A court of inferior jurisdiction composed of provincially appointed judges and justices of the peace. It is primarily a trial court, with wide jurisdiction in most family matters, and hearing most criminal and provincial offences cases.)

Supreme Court of Canada
(The highest court in the country. Its jurisdiction is derived only from statute as opposed to the constitution. It is almost entirely an appellate court. However, it also has a very limited original jurisdiction. In matters of appeal of provincial legislation, the Court hears only those cases as it deems of interest throughout the country.)

Federal Court of Appeal
(Jurisdiction in this court cannot be presumed - as can be done in a provincial superior court. Rather, it is conferred its jurisdiction as per statute. The Federal Court of Appeal hears appeals as well as trials and certain judicial reviews in the first instance. Whether a judicial review takes place in this court or the Federal Court, however, is a function of s. 18 and s. 28 of the Federal Courts Act. There is also some concurrent jurisdiction with superior courts, as well as limited criminal jurisdiction under the Competition Act.)
