I'm sure they can try, but honestly if you have a contract that they signed in which they waived their rights under lien laws, and you can show that they owe $$$ in back board and that you made reasonable attempts to collect, to notify that you are rehoming to recover your fees, etc...they wouldn't be successful in any kind of legal battle. I've had several horses abandoned at my facility and I've rehomed them to recover boarding fees. I've almost never recovered all of the board/trim, etc., fees and I've never had an owner try to sue me for selling their horse. I had one girl move to Norway and I waited almost a year before selling her horse (this was my first time dealing with this situation)...after a year, she emailed me about how her horse was doing and I told her that I had to rehome her horse due to the fact that she legally abandoned the horse at my facility. Never heard from her again....people are crazy....
