Question for barn owners

I am very curious about this issue, it seems to come up with some frequency. |
Why isn't a contract in place for each boarded horse, that states with no question what happens if a horse's board is not paid?
For example, 31 days in arrears and BO takes ownership and can keep or sell horse.
(just an example)
If horse is worth a LOT, then after board and costs to BO, balance is refunded to owner, etc. etc; blah blah blah.
But a clear and simple plan for BO without courts and sheriffs and months and months of responsibility?
Please, I'm not looking for flames or fights. There were no contracts like this back when I boarded, I think it was actually easier for BO's to take ownership back then.
I could be wrong, but no matter, the point is, I'm really interested in the now of boarding contracts.
