Danielle: Don't know where you're practicing, but California Ed. Code 56363(a) reads, "Designated instruction and services as specified in the individual education program shall be available when the instruction and services are necessary for the pupil to benefit educationally from his or her instructional program." Since the legal purpose of special education is to assure that the student receive a "free and appropriate public education" (FAPE), services provided are designed to allow access to the educational program that would not otherwise exist. Anything further (i.e. theraputic OT) is not our legal responsibility to provide. Although it would be benefitial for many students to receive additional theraputic OT, the responsibility to provide it falls to the parents. It is not that school officials are without compassion, but rather that, with such limited resources, we are unable to provide any service that is not legally required. If we did so, it would actually be a misuse of public funds.
