If someone was going to do this, as in create creatures of this sort, I doubt they're going to attempt to get a patent for it beforehand, they'll just do it and you know it. In my eyes these people are just attempting to get a go ahead, regardless of what they claim, to do it legally and without the worry of repercussion. You can disagree, I don't care, and you may be right, and I won't be disappointed if you are.
