It's a tort if you were injured in a non-criminal action. If you weren't injured (and I sure hope you weren't!) you'll want to make a claim for property damage, Al. I'd take a pic of the damaged tire, and the pot hole if you can do that safely, and submit it to the city. I would do it ASAP. In Denver, there is a Governmental Immunity Statute and you have to put them on notice, within 180 days of the incident, that you are making a claim for monetary damages. The statute is very specific on how to present the claim. So, if they don't pay up asap, let me know and I'll help you with your letter to the city after researching your statute. Let me know.
