Queen Mary had a profound respect for monarchy and the Monarch. She knelt and kissed her son's hand when he became King at his father's passing. I would expect that, however unsavory it would have been to her, if the King asked for the heirloom jewels, she would hand them over - however begrudgingly.
The fringe tiara, we now know, was her own personal possession. She was free to give it to whomever she wanted to. If indeed she gave it to the Duchess of York in August 1936, it most probably wasn't to keep it away from the grubby hands of Mrs Simpson.
